Terms and Conditions
1. Privacy
Please read our Privacy Notice carefully. By using Itafec Sevices, you signify your agreement to be bound by these conditions.
2. Electronic communications
When you use any of the Itafec Services or send emails to us, you are communicating with us electronically. We will contact you by email. For contractual purposes, you agree to receive communications from us via electronic means, and you agree that all agreements, notices, disclosures and other communications that we provide you electronically will satisfy any requirements in writing, unless mandatory applicable laws specifically require a different form of communication.
3. Copyright, author’s rights and database rights
All content hosted or made available through any Itafec Service, such as texts, graphics, logos, button icons, images, audio clips, digital downloads and compilations is the property of Itafec or its content suppliers and is protected both by European Union laws and by international authors’ right, copyright and database right laws. The compilation of all content hosted or made available through any Itafec Service is the exclusive property of Itafec, and is protected by Spanish, EU and international laws on intellectual property right and database right.
No part of the contents of any of the Itafec Services may be extracted systematically or reused without our express written consent. In particular, no data search or extraction tools or robots may be used for extraction (whether once or many times) of substantial parts of the Itafec Services to be reused without our express written consent. The user may neither create nor publish his or her own databases when these contain substantial parts of any of the Itafec Services (like our product lists and price lists) without our express written consent.
4. Trademarks
Itafec’s trademarks and trade dress may not be used in connection with any product or service that is not Itafec’s, in any manner that is likely to cause confusion among the users or in any manner that may disparage or discredit Itafec. All other trademarks not owned by Itafec that appear in any Itafec Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Itafec.
5. Licence and access
Subject to your compliance with these Conditions of Use and applicable Service Terms and your payment of any applicable fees, Itafec or its content providers grant you a limited non-exclusive, non-transferable, non-sublicensable licence to access and make personal and non-commercial use of the Itafec Services. This licence does not include any resale or commercial use of any Itafec Service or its contents; any collection and use of any product listings, description, or prices; any derivative use of any Itafec Service or its contents; any downloading or copying of account information for the benefit of another company; or any use of data mining, robots, or similar data gathering and extraction tools.
Itafec and its licensors, suppliers, publishers, rights holders or other content providers reserve all rights not expressly granted to you in these Conditions of Use or any Service Terms.
No Itafec Service, nor any part of any Itafec Service may be reproduced, duplicated, copied, sold, resold or exploited for any commercial purpose without our express written consent.
You may not frame or use framing techniques to enclose any trademark, logo or any other kind of information that is protected by copyright (including images, text, page layout or form) of Itafec without our express written consent. You may not use any meta tags, nor any other kind of “hidden text” that uses Itafec’s names or trademarks without our express written consent.
You may not misuse the Itafec Services. You may use the Itafec Services only as permitted by law. Any non-compliance on your part of these Conditions of Use or any Service Terms will terminate the licenses granted by Itafec.
6. Your Account
If you use any of the Itafec Services you are responsible for maintaining the confidentiality of your personal account number and password, and for restricting access to your computer, and to the extent permitted by applicable law you agree to accept responsibility for all activities that occur under your account or password. It is your responsibility to take the necessary steps to ensure and safeguard the confidentiality and security of your password, and you should inform us immediately if you have any reason to believe that your password has bcome known to anyone else, or if the password is being, or is likely to be used in an unauthorised manner. You are responsible for ensuring that the details you provide are correct and complete, and for informing us of any changes to the information you have provided. You can access your personal information and update it by accessing the My account section of our website.
You must not use use any of the Itafec Services: (i) in any way that causes, or is likely to cause, any Itafec Service, or any access to it to be interrupted, damaged or impaired in any way, or (ii) for fraudulent purposes, or in connection with a criminal offence or other unlawful activity, or (iii) to cause annoyance, inconvenience or anxiety.
We reserve the right to refuse access to the service, terminate accounts or remove or edit content if you are in breach of applicable laws, thes Conditions of Use or any other applicable terms and conditions, guidelines or policies.
7. Reviews, comments, communications and other content
Users may post reviews, comments and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of spam. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. We reserve the right (but not, in the absence of a valid notice form, the obligation) to remove or edit such content. If you believe that any content on or advertised for sale on any Itafec Service contains a defamatory statement, or that your intellectual property rights are being infringed by any item or information on any Itafec Service, please notify us of this situation by email and we will respond.
By posting any content or by presenting any material for publication, unless indicated otherwise, you grant: (a) Itafec a non-exclusive, royalty-free licence to use, reproduce, modify, adapt, publish, translate, create and exploit any derivative works and distribute and exhibit its content throughout the world and by any means (including the right to sublicense these rights to third parties); and (b) Itafec, its sublicensees and those who derive their denomination from Itafec, the right to use the name that you submit in connection with such content, if this was decided. No moral rights are transferred by this provision.
You agree with the irrevocable nature of the rights so conferred during the entire term of protection granted to your intellectual property rights regarding the above identified contents and material. Furthermore, you accept to undertake any additional actions that could be necessary for the purpose of formalising the cession of rights that you confer to Itafec, including subscription of whatever instrument or document, to our request.
You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is posted: (i) the content and material is accurate; and (ii) use of the content and material you supply does not breach any applicable policies or guidelines of Itafec, and will cause injury to any person or entity (guaranteeing at the same time that the content or material at issue is not difamatory). You agree to indemnify Itafec for all claims brought by any third party against Itafec arising out of or in connection with the content and material you supply except to the extent that any liability arises from our failure to properly remove the content when it is notified of the illegal nature of the content (through the corresponding electronic mail) arising out of or on the grounds of, or originating from the content that you have communicated to us.
8. Intellectual Property claims
Itafec respects the intellectual property of others. If you believ that your intellectual property rights may have been infringed, please contact us by electronic mail.
9. Our liability
We will do our utmost to ensure that availability of the Itafec Services will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to Itafec Services may be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new products or services. We will do our utmost to limit the frequency and duration of such suspension or restriction.
Itafec will not be responsible for (i) losses that are not caused by any breach on our part, (ii) any business loss (including loss of profit, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure), or (iii) any indirect or consequential losses that were not foreseeable to both you and us when you commenced using the Itafec Services. We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect the client’s legal right to receive the product or the corresponding service delivery within a reasonable time or to receive the appropriate refund in case we should no be able to provide the products or services within a reasonable period owing to a cause beyond our reasonable control. The laws of some countries do not allow some or all of the limitations described above. If these laws apply to you, some or all of the above limitations may not apply to you and you might have additional rights.
10. Applicable law
These conditions are governed and construed in accordance with the laws of the Kingdom of Spain and of the European Union. We both agree to submit to the exclusive jurisdiction of the courts of the city of Madrid.
11. Alterations to Service or Amendments to the Conditions of Use
We reserve the right to make changes to any Itafec Services, policies, terms and conditions, including these Conditions of Use, and Service Terms at any time. You will be subject to the terms and conditions, policies, Conditions of Use and General Service Terms in force at the time that you use the Itafec Services. If any of these Conditions of Use or General Service Terms is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
12. Waiver
If you breach these Conditions of Use and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Conditions of Use.

14. Notice and procedure for making claims of right infringements
If you believe that your rights are being infringed, you may send us a completed electronic mail. We will respond inmediately. Upon receipt of the mail, we may take certain actions which might include suppression of the information or the product in question, without any admission as to liability and without prejudice to any rights, remedies or defenses, all of which are expressly reserved.
